The Malawi Electoral Commission, “the Commission”, is a body created under Section 75(1) of the Constitution of the Republic of Malawi, to supervise, direct and preside over the conduct of all elections in Malawi. In accordance with Section 13 of the Electoral Commission Act, the Commission seeks to appoint suitably qualified persons with relevant experience to fill the following vacant positions that exist within its secretariat:
Job Title : Legal Services Manager
Grade : C4
Responsible to: Director of Legal Services
Purpose
To manage the day to day legal responsibilities of, and to provide legal advice to, the Commission
Key Duties and Responsibilities:
The Legal Services Manager shall be assisting the Director of Legal Services in the following:

- Providing legal advice to the Commission on procedural and substantive issues relating to electoral laws;
- Formulating and reviewing of policies and procedures manuals designed to ensure that the Commission and is employees comply with the relevant electoral laws and other laws relating to the day-to-day management of the commission:
- Monitoring Commission activities and providing relevant legal advice to the Commission to ensure compliance with statutory requirements:
- Preparing legal briefs for the Commission’s consideration;
- Reviewing proposals and preparing statutory instruments and gazette notices as required;
- Coordinating with the Attorney General Office on legal matters of public interest related to the functions of the Commission:
- Liaising on behalf of the Commission for the engagement of legal firms to represent the Commission on special assignments, monitors the performance of the legal firms and counsel engaged to conduct litigation on behalf of the commission and taking necessary aclion to ensure that performance is to the required standard;
- Representing the commission in court on matters commenced by or against the Commission:
- Preparing agenda for meetings of members of the commission and ensures that all the members receive the agenda and necessary documentation for the meetings;
- Drafting routine responses to external communication as directed by the Chief Elections Officer or the Commission, and carrying out background research to get and organize information required by the members of commission to make decision or to take action:
- Reviewing legal implications in existing legislation and policies and recommends new legislation and amendments to existing legislation or policies;
- Coordination of functions of Multi-Party Liaison Committees (MPLCs) in District and Local Councils.
- Facilitation of handling and determination of electoral complaints during all stages of the electoral process.
- Acting as liaison point with Parliamentary committees on all matters relating to the conduct of elections and terms and conditions of service of Commissioners.
- Company Secretarial undertakings for the Commission and its Committees as designated by the Commission under the Electoral Commission Act.
- Drafting summary of results for all elections
Requisite Academic Qualifications and Experience Desired

- Master’s degree in law plus three (31 ears post admission practice with a valid practicing license.
